CNN —The Supreme Court on Tuesday agreed to freeze a lower court order that bars the government from regulating so-called ghost guns – untraceable homemade weapons – as firearms under federal law. Ghost guns are kits that a user can buy online to assemble a fully functional firearm. The rule does not prohibit the sale or possession of any ghost gun kit, nor does it block an individual from purchasing such a kit. A federal appeals court declined to put on hold two key challenged provisions of the regulation. A handful of retailers of ghost gun kits as well as a gun rights’ group also challenged the rule.

Supreme Court allows Biden ‘ghost gun’ regulations

WASHINGTON — A divided Supreme Court on Tuesday allowed the Biden administration to enforce regulations aimed at clamping down on so-called ghost guns — firearm-making kits available online that people can assemble at home. Plaintiffs also include gun rights groups and makers and sellers of ghost guns. Tuesday's ruling was not a final decision and the Supreme Court could still hear the case and issue a detailed decision on the merits. On July 28, Justice Samuel Alito temporarily put the Texas ruling on hold while the Supreme Court decided on what next steps to take. The ghost guns case, however, is on a separate legal question related to ATF's regulatory authority, not the right to bear arms.

She then spent 70 days alone in her Manhattan apartment, too sick and then too afraid to leave. “Somehow the pandemic fueled us to work harder,” Ms. Stroman, 68, says. DeSantis ripped Disney repeatedly this week over its recent maneuvers to thwart the governor's efforts to seize some control of the company's Orlando parks and properties. Meanwhile, his handpicked board of supervisors overseeing Disney World's special tax district increased the pressure on Disney. The board took that step two days after DeSantis floated a range of possible actions against Disney World, including developing land nearby. That legislation, dubbed "Don't Say Gay" by critics, "should never have been signed" by DeSantis, Disney said in a March 2022 statement. The state's Republican governor and GOP-held legislature targeted the special tax district that has allowed Disney to essentially govern itself for decades.

The position of others including Chief Justice John Roberts was harder to read, raising the possibility of a ruling less broad than the Republican state lawmakers pursuing the appeal seek. The Republican lawmakers are asking the Supreme Court to embrace a once-marginal legal theory that has gained favor among some conservatives called the "independent state legislature" doctrine. The Republican lawmakers have argued that the state court unconstitutionally usurped the North Carolina General Assembly's authority to regulate federal elections. Thompson also argued that state constitutions cannot impose substantive limits on the actions of legislatures on federal elections. A lower state court subsequently rejected the legislature's redrawn map and adopted one drawn by a bipartisan group of experts.
The Supreme Court's eventual decision, due by the end of June, could apply to 2024 elections including the U.S. presidential race. The Republican lawmakers have argued that the state court unconstitutionally usurped the North Carolina General Assembly's authority to regulate federal elections. Kagan noted that in a series of cases over the years the Supreme Court expressed that state courts had a role to play in this area. A lower state court subsequently rejected the legislature's redrawn map and adopted a new map drawn by a bipartisan group of experts.
